PlanSwift Referral Terms and Conditions

By filling out the signup, form you acknowledge that you have read the terms and conditions, and that you understand and agree with them.
 

By filling out the signup form, and upon acceptance, you will become a Referral Partner and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referred individuals.
 

It is understood that you will introduce the PlanSwift software to your current and prospective customers and will comply with all laws including those that govern email marketing and anti-spam laws. PlanSwift reserves the right to accept or reject any prospective customers and will pay you a commission on PlanSwift software sales made from a customer referred by using your AID code. Either you or PlanSwift may terminate the relationship at any time. You are only eligible to earn commission payments during your time as an approved Referral Partner. PlanSwift may change the program, commission rate, service policies, and operating procedures at any time.

The Referral Partner is an independent contractor for PlanSwift. PlanSwift is not liable for indirect, special or consequential damages arising in connection with this program. In no case shall PlanSwift aggregate liability arising with respect to this program exceed the total referral fees paid or payable to you. PlanSwift makes no express or implied warranties or representations with respect to the program. In addition, PlanSwift makes no representation that the operation of the service will be uninterrupted or error-free, and PlanSwift will not be liable for the consequences of any interruptions or errors.

Your Referral Program application and status in the program may be suspended or terminated for any reason, including the following.  

You may use graphic and text links both on your website and in emails. The site may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by PlanSwift, or you may create your own as long as they are deemed appropriate according to the conditions above and prior approval has been granted by PlanSwift. Planswift Partners are prohibited from using "Planswift", or any term that can be misconstrued as "Planswift" in online adword placement within internet search engines or within any URL web addresses. Text manipulation, or the separation of terms is also expressly prohibited. At the discretion of Planswift, any partner who willfully enters into such an advertising campaign can be denied commissions stemming from such a lead source, or have their partnership status revoked entirely. Planswift reserves the right to add, modify, or otherwise change approved advertising strategies or methods at any time, for any reason.   
 

PlanSwift only tracks leads when a contact goes through your Referral Partner link, which is supplied, to you upon approval of your application. PlanSwift has no way of tracking the customer back to you if they do not use your link. PlanSwift is not obligated to pay commissions on a sale that is not electronically tracked to your referral identification number (AID). 

Commissions will be paid on sales for a period of 1 year on each referred customer unless other arrangements have been agreed to in advance by PlanSwift. Commissions are based on the total sale price of software and maintenance at the time of "check out" for the first year only. Referral commissions will not be paid on any third-party "plug-ins". Commissions for sales will not be paid to individual Referral Partners, or organizations, who use the Partner Program as a means to obtain licenses at a discounted rate either for their own or company use. Planswift is not required to honor transactions that are believed to be manipulative or otherwise disingenuous in nature. 

These terms will go into effect upon approval of your Referral Program application and will end when your Referral account is terminated. The terms of this agreement may be modified by PlanSwift at any time. If any modification to the terms is unacceptable to you and a mutual agreement cannot be reached, either party is free to terminate the referral partnership at any time. Commissions will not be paid on sales made after termination date. Your continuing participation in the program will constitute your acceptance of any changes. Your acceptance and enrollment in no way constitutes a contract of any kind with PlanSwift. All referred leads and the information pertaining thereto become the sole property of PlanSwift. 

 

PlanSwift is not liable for indirect or accidental damages (loss of revenue, commissions, etc.) due to referral tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. PlanSwift does not make any expressed or implied warranties with respect to the Referral program and/or products sold at this site. PlanSwift makes no claim that the operation of the Referral program and our website will be error-free and PlanSwift will not be liable for any interruptions or errors.

Tech Unlimited, Inc (dba PlanSwift) reserves the right to modify this agreement at any time at the sole discretion of PlanSwift.
